Too Much Power for MLAs and MPs.
February 08, 2009
In India, the Legislative members have too much power. The power is not balanced. The MLAs and MPs can make or break the Chief Executive; Any day, any time, any one can become the Chief Executive and in the same way, he/she can lose the job too.
In India, the Chief Executive is not directly elected by the People. That is the root cause for the Instability.
In every five years they conduct election to choose the next government. In that election process, people do not directly elect the Chief Executive. People elect their Representatives for the Legislature. Then the elected Legislative members choose the Chief Executive.
The Legislative members have too much power; they can make anyone the Chief Executive on any day and at any time; they can also send the Chief Executive home on any day and at any time. The MLAs and MPs have too much power and they are the King/Queen makers. The power is not balanced at all.
The Legislative members, MLAs and MPs have too much Authority; they have no Responsibility; and are not accountable for any thing.
The Chief Executive, is known as the Prime Minister for the nation and Chief Minister for the state. In fact, the Chief Executive has no power. The Chief Executive is a very weak position in the Indian Democracy.
The Chief Executive has no Authority; but the Chief Executive has all the Responsibility; and also accountable for the outcome.
The Chief Executive position in Indian Democracy is totally and completely Unstable. Everyday, the Chief Executive needs to check, whether he/she still the Prime Minister of the nation or the Chief Minister of the state.
Its just a number game. A bunch of MLAs and MPs can meet in the evening and change the Chief Executive with a very simple procedure. It is a weak, unstable political system.
In India, they have the Electronic Voting Machine; they spend a lot of tax money to conduct the election; but the outcome is chaos and confusion.
Its a simple change. Just ask the people to elect the Chief Executive directly. Thats all. Let the people be Responsible for the selection of their Chief Executive. This change will solve the Instability issue and also make the power balanced.
Executive power will be balanced with the Legislative Power.
Look at the Constitution of the hindu religion, our ancestors created.
Creator - Protector - Destroyer.
Power is very well balanced. They have Responsibility and have enough Authority to do their job independently with total freedom. They are Accountable for the outcome. If the outcome is the right one, they get an award and if the outcome is a wrong one, they get punishment too.
In Indian Democracy, the MLAs and MPs have both Creator and Destroyer power. The Chief Executive is the Protector.
So, direct election of the Chief Executive will solve this crisis. But the parties will not agree for this solution. Because, that will be the end of their political party.
Alternatively, give only the Creator power to the Legislative and take away the Destroyer power from them.
That means, after the election, the MLAs and MPs assemble and choose the Chief Executive. That is it. Once created, thats all. They can not bring down the Chief Executive.
Let me make it clear to you. Take the No-Confidence motion rights away from the MLAs and MPs.
If there is no No-Confidence motion, then the Chief Executive will get stability and she/he will do the job effectively.
Then how can we bring down the Ineffective Chief Executive?
Give the power to the Judicial Branch.
If anyone have any problem with the Chief Executive, then they can file a case against the Chief Executive in the Judicial Branch. Let the judges investigate and give their verdict. Based on the verdict, take action against the Chief Executive.
If the Chief Executive is guilty, then impeach the Chief Executive.
If the Chief Executive is not guilty, let her/him continue.
Its time for some action. Inaction will be very expensive.
